What are Presumptive Conditions?

Presumptive service connection means the VA assumes certain conditions are related to military service without requiring you to prove the connection. If you served in a qualifying location during the specified time period and develop a presumptive condition, the VA presumes your service caused the condition. You still need a current diagnosis, but you don't need a medical nexus opinion.

The PACT Act (2022)

The PACT Act is the largest expansion of VA health care and benefits in decades. It added over 33 new presumptive conditions related to burn pit and toxic exposure for Gulf War and post-9/11 veterans. The act also expanded Agent Orange presumptive locations and added five new conditions in 2024-2025.

How to File for Presumptive Conditions

  1. Verify your service dates and locations qualify
  2. Get a current medical diagnosis for the presumptive condition
  3. File VA Form 21-526EZ (Application for Disability Compensation)
  4. Clearly state this is a presumptive condition and reference the presumptive category (PACT Act, Agent Orange, etc.)
  5. No nexus letter needed, but medical records showing diagnosis are required

What if I'm Denied?

If your presumptive condition claim is denied, it's often due to insufficient medical evidence of current diagnosis or service dates/locations not matching VA records. You can file a supplemental claim with additional evidence or request a higher-level review. Consult with a VSO or VA-accredited attorney for complex denials.

PACT Act - Burn Pits & Toxic Exposure

Veterans who served in Vietnam, the Korean DMZ, or on certain Navy vessels are presumed to have been exposed to Agent Orange and other herbicides.

Radiation Exposure

Veterans who participated in nuclear weapons testing or were prisoners of war in Japan are presumed to have been exposed to ionizing radiation.
